Criminal Code

The Criminal Code of Canada makes it illegal to gamble or conduct any gaming activities in Canada unless they fall within recognized exceptions set out in the Code.

In 1970, the Federal Government amended the Criminal Code to make an exception to the general rule by allowing two basic forms of gaming:


  • gaming by a provincial government or by an agent of the Province,
  • gaming by charitable or religious organizations, fairs and exhibitions and amusement operations through a license granted by a provincial body.

Section 207(1) (a) of the Criminal Code of Canada permits gaming that is conducted and managed by a Province. The Nova Scotia Gaming Corporation was created through Part I of the Gaming Control Act on February 15, 1995, as the agent of the Province to conduct and manage gaming.
